De reactie van de EC op de vraag: “is it correct that the EC did not warn the Dutch government for legal consequences if the number of flights was reduced to 467.000 per year, which is outside the bandwidth of 475.000 and 485.000 notificated in September?”
Yes, this is correct. The Commission simply requested that the Dutch government specify the exact movement cap, as this detail was necessary to assess the proposed restrictions’ compliance with EU law. The Dutch government had initially indicated a movement cap of 475,000-485,000 which was not precise enough. This is why then, on 6 December, the Dutch authorities provided the additional information including the Dutch government’s decision to cap annual movements at Schiphol at 478.000.
If the Dutch government had proposed a flight cap outside the initially indicated range of 475,000 to 485,000, such as 467,000 or 488,000 for example, it would have been required to submit a new balanced approach notification, as per standard procedure.
De tweede vraag was: Is there a legal issue when the reduction of yearly flights is lower than the bandwidth in order to reach the sound reduction target of 17% ?
“We can tell you that the Commission services are currently reviewing the balanced approach process carried out by the Dutch authorities to determine whether the measures chosen to mitigate noise are the most cost-effective and proportionate ones to reach the noise objective. The Commission has three months to review the notification and will communicate on the outcome of the review. This is all we can tell you for the moment”.
